We've all heard the negative comments made in the British press with tiresome regularity about the 'pitfalls' of buying property in Spain and how you might invest your life's savings in a property only to find that it is, in fact, illegal. It is just this kind of damaging publicity that we are doing our utmost to counter. Decree 218/2005 is a law which was introduced by the Junta de Andalucía in 2005. Its aim is to achieve greater transparency in the property market and to safeguard clients by providing them with full information and thus protecting their financial interests.
Estate Agents are required to obtain certain documents from property owners who ask them to market their property. By obtaining all necessary documentation and ensuring that it is correct, we can alleviate any concerns that potential buyers might have and verify that their dream home in the sun is both legal and above board. Home owners are often surprised when their documentation is not entirely correct. Even if you used the services of a lawyer when you bought your house, there can still be issues which need to be addressed in relation to your Escritura, IBI or utility bills.
Property Information Pack
At Sunset Properties, we offer a comprehensive Property Information Pack which you can make available to all the agents you wish to use with the minimum of fuss and effort for you – we will do all of the hard work! We will visit you at your property and carry out a full check of all documents relating to that property. Then we will supply you with a report indicating any problems which need to be sorted out. The sale of a property with the right documentation is much less likely to be delayed or to fail than one where there are problems to resolve. We will check your Escritura (title deeds), the Catastro (the overall plan of all land and property in
Spain), your IBI (council tax) and advise you what, if anything, needs to be done. From your paperwork, we will prepare a pack for you which will contain copy documents so that you can provide the required information to any estate agent whom you wish to market your property. This will include copies of your Escritura, IBI, electricity, water and telephone bills, community details, passports, residencia/NIE certificates and a list of any furniture to be included in the sale.
Nota Simple
One major requirement of the Decree 218/2005 is that all estate agents are required to have a current Nota Simple (extract from the land register) for your property. You can obtain this yourself from the Land Registry in Torrox. It costs a few Euros and will normally necessitate two visits to the office in Torrox. Alternatively, we can order one for you via the internet. It usually arrives on the same day that the request is made and means you don't even have to leave your house!
Town Hall Certificates
Recently we have had experience of buyers' lawyers and mortgage providers insisting on a certificado de no infracciones de urbanistica. This is a certificate supplied by the local town hall which confirms that they have no outstanding issues with your property. Applying for this certificate can entail several visits to the town hall and it can take some time to obtain. You can of course do this yourself or, you can let us do the legwork for you!
